Description:
Building roof is partially collapsed. In obviously dangerous condition, even to the untrained eye of this retired Sun editor. Gang graffiti covers the outside. Open doors and windows. Have seen numerous vagrants on the property. Hard to believe it has not been reported and demolished, since it has stood this way for years. It is across street from one church and next to new Passage Church property just to the west. To the east is one residence and the Road Prison. Let's get this guy out of here!

Description:
It is easy to spot. It seems they are operating a scrap yard. They are either doing auto repairs or just taking apart autos with a large lift in the front yard. There are usually no less than 7-10 cars in different states of dis-repair. There are parts of trucks, parts of a/c units, lots of tires and other junk thrown about the yard. Most stuck behind a small shed next to a stream.

Description:
Between all 3 places 1628, John Wilds "wood shop" 2 houses down from that home, and John Wilds apartment in southern Pines is where he keeps laundering "nic and dime" bags of marijuana & serving "homemade hooch" (alcohol) whom rents from Mr. Wong who suposedly works with people as marijuana gets laundered from Lynn Cummings-another rentor, John Wilds who is supposedly married, Michelle L. Dubios who claims she is doing right for her 3 children with prostituion of Frankie D. Withey who claims he is married & claims he is paying rent traveling from house to house with cigarettes, weed, and rolling papers. These are all people who have not yet been evicted. There is another couple whom also have not yet been vacated from their homes who claim to have been evicted and sleep in their evicted-from apartments live with no electricity in woodcrest apartments. John Wilds goes by the name crow and supposedly is "trying to do this for his son." 1628 sw 42 st is the ugliest house I have ever seen. The outside is at least halfway decent, yet the inside the floor is all tore up, no working wash machine & dryer, bathroom door does not close, no bedroom doors for the first bedroom in there you see, a table full of cigarette butts, ashes, and dust. The couch all tore up spider webs & roaches in every wall corner and everybody's stuff. There are rats in the walls and in tanks. Kitchen sink faucet is not working properly because the handle is disfunctional and Frankie D. Withey and Michelle Dubois stick up for this house when in use for prostitution, marijuana, and alcohol.

Description:
Athletic fields for soccer and baseball have been constructed, and are currently being maintained, on the property. The construction of those fields was an expansion of the then-existing use which was being made of the property under a Special Use Permit and, in addition, caused additional impacts to surrounding properties.

As a consequence, under the provisions of the ULDC and the Code provisions that were in effect prior to the adoption of the ULDC, an amendment of the Special Use Permit to allow the construction of those fields had to first be approved by the Board of County Commissioners after a duly noticed public hearing. For the hearing to have been duly noticed, the public and surrounding property owners had to be given proper notice that an application for the construction of those fields had been made, together with notice of the date and time of the public hearing on that application.

Neither the public nor surrounding property owners ever received such notice. In fact, The Rock of Gainesville, Inc., has only submitted one application for the amendment of its Special Use Permit to allow the construction and use of athletic fields, and that application was denied by the Board of County Commissioners in Resolution Z-97-8. After 1997, The Rock of Gainesville, Inc., never again made an application to the Board of County Commissioners for an amendment to its Special Use Permit to allow athletic fields.

Instead, it submitted an application to the Development Review Committee for approval of a revised final development plan that included those fields. The DRC approved that application in violation of the Alachua County Code which specifically provided that only the Board of County Commissioners had the power to approve an application involving either a minor or major change to a Special Use Permit.

It is well-established law in the state of Florida that a permit issued by a governmental authority in violation of its governing Code or Comprehensive Plan is ultra vires and void ab initio. Accordingly, The Rock of Gainesville, Inc., constructed athletic fields on its property in violation of the Alachua County Code and is currently maintaining and operating those fields in violation of the ULDC.

Vehicles are routinely parked on the grass and unpaved areas behind the gym during the weekdays. A picture that appears on page 5 of the revised DRC Staff Report for Project Number 2010112401_RF reveals some of that parking.

Further, vehicles are routinely parked on the athletic fields and on the grass and unpaved areas behind the gym, along the fence line for the athletic fields, and along the back fence line for Sunday church services. Pictures from this past Sunday are attached.

One or more of those grass and unpaved areas are also routinely used for parking during athletic events for the school and other church services.

The parking that occurs on the grass along the property lines is invariably done within the required buffer.

Said parking is in direct violation of the provisions of Sections 407.20, 407.21 & 407.43(b)1e of the ULDC.
